During a multi-million dollar construction project, a complex delay-in-completion claim led to a third-party settlement.

Washington-SquareWashington Square is a luxury condominium complex located in Bellevue, Washington. The developer experienced a delay in completion of the project when rain leaked into the tower roof.

Because the incident happened in the middle of the construction project, the delay was very expensive and hotly contested. The length of the delay, the specific items that should be considered recoverable expenses, the value of those expenses, and what delays were due to other factors all came into play. It ultimately took the mediation skills and expertise of a third party to settle this claim. Hutson Resource Group helped Washington Square to prepare for mediation and John Hutson testified at this mediation.

How can you recover lost profits when there are no profits associated with R&D?

Mentor-GraphicsWhen a fire destroyed the Mentor Graphics R&D center in Moscow, no one knew what was recoverable under the policy. How can a high-tech company recover lost profits when there are no profits directly associated with R&D?

If a business has an R&D segment, having R&D business income coverage is an excellent idea. Many R&D ventures produce no direct sales or profits, and normal operating expenses are absorbed by the company. After a loss at an R&D facility, like any other business interruption loss, there are expenses that continue to accrue (like payroll, rent, utilities, insurance) but that provide no benefit to the company because normal R&D activities are on hold. With the right R&D coverage, the ongoing expenses can be recovered.

After a hurricane hit Galveston, Texas, an entire chain of pizza restaurants was out of commission.

marwinThe Marwin Group owned 34 CiCi’s Pizza restaurants that were ravaged by Hurricane Ike, which roared ashore in Galveston, Texas, in September 2008. The group’s owners were frustrated with submitting a complex business interruption insurance claim, because there was no one to guide them through the process.

With all of the locations out of commission, the impact on revenue was immediate and severe. Different locations were covered under different policies, and deductibles, wait times, and exclusions varied from store to store. The insured didn’t know where to start, but they ultimately had a great finish.
